Purpose and relationship to consumer rights
This policy explains how NYCC handles refund, cancellation and digital-delivery issues for downloadable assets. It does not limit rights or remedies that cannot be waived under applicable consumer-protection law. Where this policy conflicts with a mandatory legal right, the mandatory right applies.
Digital-content purchases
Digital files can be copied once download access is provided. For that reason, NYCC may treat completed digital-asset purchases as final once the purchased file has been accessed or downloaded, except where required by law or where the purchase qualifies for one of the remedies below. The checkout should clearly disclose this before payment.
Before a file is downloaded
If a purchaser contacts NYCC promptly before any purchased file has been accessed or downloaded, NYCC may review a cancellation or correction request. This is a discretionary customer-service policy unless law requires a cancellation right. Final launch wording should match the technical ability to verify whether secure download access has been used.
Problems that qualify for support or refund review
NYCC should investigate duplicate charges; a file that is materially corrupted or cannot be opened in the advertised format; delivery failure that NYCC cannot correct; a materially incorrect file compared with the asset purchased; or an unauthorized transaction reported through the proper security process. NYCC may first offer a corrected file, replacement download or technical fix where that fully resolves the issue.
Situations normally not refundable
Subject to mandatory law, refunds would normally not be available for change of mind after download; choosing the wrong size or format when the order accurately showed the selection; lack of software needed to open a correctly described file; dissatisfaction with subjective creative suitability after the preview and metadata were available; or use that later turns out to require rights beyond the Standard Licence.
How to request help
The purchaser should contact NYCC at mac@nuycc.ca or through the website contact form and provide the order number, asset name, problem description and any relevant technical details. NYCC should verify account ownership before changing access or refunding an order.
Approved refunds
If NYCC approves a refund, it should normally be returned to the original payment method. Processing time depends on the payment provider and financial institution. Any associated licence rights for the refunded asset should cease, and the purchaser should delete retained source copies unless law provides otherwise or NYCC confirms a different remedy in writing.
Partial orders and file upgrades
Where an order contains multiple assets, a problem with one asset does not necessarily require refunding the entire order. If NYCC later offers paid upgrades from smaller to larger raster sizes, the policy should state whether the customer pays the difference or makes a new purchase. Phase 1 should avoid promising upgrade pricing until it is implemented.
Chargebacks and fraud
Customers should contact NYCC first where possible so ordinary delivery or billing problems can be resolved. NYCC may suspend downloads associated with fraudulent, reversed or charged-back transactions while the dispute is investigated. This does not prevent a customer from exercising rights available through a card issuer or by law.
Pricing transparency and taxes
All prices are stated and charged in Canadian dollars (CAD). NYCC has advised that it is tax-exempt and does not currently add sales tax at checkout. Refund calculations should use the amount actually charged for the affected item. NYCC should not retain hidden mandatory fees.
Contact and policy changes
Refund and download-support questions should be sent to mac@nuycc.ca. Nunavut Youth Creative Collective, 436 Atungauyait Drive, Iqaluit, NU X0A 2H0, Canada. NYCC may update this policy prospectively, but the policy presented at the time of purchase should remain available with the order record where practical.
